The Will is the centerpiece of estate planning. It provides for the legal transfer of assets after an individual’s death, names an individual or entity to settle the probate estate, names a trustee to administer any testamentary trust established, and appoints a guardian for any minor or disabled children. However, a number of factors must be considered to determine the best type of Will to meet your individual needs. In addition to the Will, clients need to discuss advance directives (living wills) and powers of attorney.
With the continued increase of our elderly population, as well as the commensurate growth in medical costs, including nursing home costs, it essential to meet with a competent attorney to discuss all your options and tailor a Will package that best meets your needs.
In addition to the Will package, many clients find the need to discuss creating a Trust. Trusts can be broken down into three categories: (1) simple estate planning trusts; (2) tax planning trusts; (3) public planning trusts.
Furthermore, working with a competent attorney allows you to explore a variety of issues including capitalizing on each person’s estate tax exemption, planning for the needs of a dependent child or surviving spouse and avoiding the potential for Will contests.
